      ek consumer koi cheej purchase karta hai or wo mar jata hai uska bachcha us cheej ke kharab hone ke liye consumer court mai jata hai waha consumer foram ka president yah kahta hai ki aap complent nahi kar sakte kyon ki aap consumer nahi hai aapke father consumer hai or wo complent cancle kar deta hai aisi condition mai kya karna chahiye ?

    Such a nice article in support of the ‘Jago Grahak Jago’ ads., though FAR FROM TRUTH unfortunately.

    1. The complain is expected in typed and predefined format, unlike stated here on a plain paper with various items. So a common man has to take help of a professionals.

    2. The fees is very nominal, however to pay it, you’ve to go to the bank and have a bankers cheque or demand draft only.

    3. When you submit it all wasting almost a days time, your complain is not become a part of redressal process. For that, you’ve to go to the forum next day so that they give you the prepared notice cover to be send to the opposite party thru registered AD. The forum don’t do it themselves!

    4. The first hearing date that you will receive is 30 days from the date of you receiving those covers to be posted to opposite parties from your side.

    5. Don’t expect that opposite party will reply after 1 month. Their advocate come to the forum and give some undertaking stating they didn’t get the necessary from their client to submit vakalatnama and take another hearing date 8-10 days later.

    6. Again 8-10 days later, the opposite party advocate submits vakalatnama demanding another 8-10 days time to submit reply.

    7. Almost 2 months have passed and you are now expected to produce the evidences and reply on affidavit to the opposite party reply. Here again you need to take help of the professional and devote time to do the required.

    8. you will get another hearing date 15 days from the date of you submitting the necessary though don’t expect the opposite party to reply.

    9. They will come and take another hearing extension for one or the other reason and even after you object to it in written, it will be granted.

    10. 3.5 months have gone and they are expected to reply with affidavit. Instead they will come with a one page document with some questions with reference to the reply that you’ve given. The answers to these questions lies in your complain and subsequent reply, even though this is just a tactic used by opposite party to take another hearing extension, granted with equal generosity as before.

    11. You gave answers to those questions again or just reply stating you’ve already answered them but it won’t spare you from 10-15 days of hearing extension.

    12. The opposite party will take your answers and another extension to submit their affidavit.

    13. Almost 4.5-5 months gone by the time the will submit their reply with afidavit and evidences.

    14. Now comes the turn for written arguments. Another 10-15 days extension.

    15. Even if you submit not having written arguments except for what you replied earlier, they will give a simple 1 page arguments to take one more hearing extension.

    16. Now comes the time for oral arguments. Again, they will take extension for one or the other reason.

    17. Finally, when it comes to do the actual arguments, the court will that runs from 3:30pm to 5pm daily will not have time to listen to your arguments so you will be given another hearing extension.

    18. Hopefully, you’ll finish your arguments in the next hearing and then comes opposite parties turn to do their arguments. Here again, you would be lucky if they finish it in one hearing, else it will go for next hearing.

    19. After they finish their argument, where they will give bulky citation of the higher courts that you would require to study and revert in support of your complaint. Again you would need professional help.

    20. Finally, you do that also and the hearing is over. Now it is due for justice. As per the Consumer Protection Regulation 2005 Para 18(7), it should be delivered invariably within 15 days from the completion of hearing. Unfortunately, it is only on paper.

    21. You will get a judgment date 1-1.5 months from the date of your last hearing.

    22. After all the time, money and efforts you’ve put-in for so long, when you go to receive the judgment, you will get another hearing date again delaying it for 1-1.5 months.

    23. AND VERY IMPORTANTLY, all these while I didn’t mention any hearing adjournment for either the president, or the member being on leave because the bench don’t sit without at least a member accompanying the President and the forum runs with only one member unfortunately! So you can expect at least 2-3 hearing adjournment only for these reasons.

    So, the bottomline is ‘Jago Grahak Jago’ if you don’t have anything else to do, and if you are living in the same city where the forum sits, and if your claim amount is indeed big, and you are ready to spend about 10000 over a period of 8-10 months (being very optimistic and persuasive). In the end, there is no guarantee that you will get your reward, for standing against the professional advocates defending the opposite party.

    I personally saw a lady attending the hearing on behalf of her husband earning 200-300 Rs. a day, for over 4 months telling the forum that her husband has appeared couple of times earlier but nothing happened and the hearing was adjourned resulting in a loss of his days at work so she had no option but to come on behalf of her husband. Of course, there will be provision to address that but to know that, first you’ll have to face the same, because the forum or its staff are not there to aware you beforehand.

    It is Oct 2, 2015 today and I heard our PM modiji in their address in Jharkhand stating that he heard some judges in UP court complaining that because there was no electricity in the court, the court was sitting only 2 days in a week so they were not able to attend to the cases and now that court runs thru solar energy.

    Mr. Modi, I am from Gujarat and my City Rajkot has no electricity problem though the president of the forum claims that he has been given 5 charges so he doesn’t have time to attend to the cases in timely manner. If you please give job to the jobless and relieve the president from those extra charges given to him, it would be good for the jobless and Grahak also. I hope these reaches you.

    Aap ne jo bataya wo bahut aacha laga.but aaj bhe consumer court ke kuch rules and regulation thik nahe hai unme kuch badlaau hone chaheye.aise he ak ghatna mere sath hue hai.
    Maine online company shopclues se ak 40″ Samsung ka tv purchase kiya tha.but payment karne ke baad bhe mujhe time pe tv delivery nahe mili. Maine bahut complain ke lakin kuch nahe hua mujhe sirf 48 hours ka time de diya jaata. Jab maine shopclues ko mail kiya ke agar aap mera tv nahe doge to mai consumer court me complain karu ga.tab shopclues ne mere paise me account me bhej diya.wo bhe 50 days ke baad.
    Mai iske complain karne aur shopclues pe case karne consumer court gaya to mujhe bataya gaya ke ye case yaha nahe ho sakta kyo ke shopclues ka office Kolkata me nahe hai aap ko Gujarat jana ho ga jaha inka office hai.
    Ab aap mujhe bataye ke mai kya karu. Mai apne sare kaam chor ke Gujarat to jaa nahe sakta case karne. Consumer court ke rules me kuch change hona chaheye.

      Yeh baat sahi hai ki har samasya ka samadhan nahi hai. Lekin agar ham thode se smart tarike se problem ko solve karne ki koshish kare to 100% nahi to 70% problem to solve ho hi jayegi. Is tarah ki aam logo ki samasyaon ke liye hame sahi time par sahi logon se sampark karna hota hai kyonki jyadatar mamlo me ham sahi logon tak pahunch nahi paate isliye hame lagta hai ki problem solve nahi hogi. Lekin ab technology ke daur me ham sahi logo tak pahunch sakte hai.

    Mere mobile ka 2nd SIM slot Kam Ni kr Raha hai, jo ki Maine online mangaya tha. Delivery ke 10 din bad Maine us slot me SIM lagaya tab mujhe pata chala. TB tak 1st slot bad use kar Raha tha. Jab mai service centre le k gaya to Bolte hai SIM slot damage hai. 5000 kharcha hoga, aur mobile 10000 ka hai. Mobile warranty me hai.
    Mere case jeetne k kitne chans hai???

    Agar kisi company ka employee customer ko cheat kar ke business karta he. Or customer ko bad me pata chalta hai ki usko cheat kiya gaya tha.
    Or company ki policy hai ki paise vapis nahi diye jate.
    To ab customer apne paise vapis kese le skta hai?

    Or law ke konse section me iska solution hai?

    श्रीमान यदि किसी व्यक्ति द्वारा आवश्यकता बताते हुए पैसा उधार लिया जाता है और समय निकल जाने पर उसके द्वारा लोभ आजाने या जानबूझकर पैसा देने की नियत नही हो तो उसके खिलाफ केसे कार्यवाही करे की उपभोक्ता फोरम में इसका भी कोई कानून है
